Terms of Service

Enterprise service level agreements, procurement conditions, and supply chain governance guidelines.

Please review these Terms of Service carefully before purchasing parts, arranging site installations, or finalizing rental bypass deployments with PowerStream. These terms define our operational boundaries, SLA commitments, and mutual liabilities.

1. Scope of Service & Agreements

These Terms of Service govern all transactions, equipment supply agreements, and rental contracts executed by PowerStream Solutions. By requesting a technical consultation, submitting an RFQ, or utilizing our rental dewatering and pump bypass systems, you agree to comply with these terms and any associated Service Level Agreements (SLAs).

2. Equipment Rental Terms & SLAs

All pump and power rentals are subject to pre-delivery inspection and load-testing. PowerStream guarantees that all rental units are maintained to OEM standards. Rental periods begin when the equipment leaves our Pune warehouse and terminate upon its return. We provide 24/7 technical support and field maintenance for the duration of the rental agreement. Routine wear-and-tear is covered under the rental fee, but damage caused by improper operation, dry-running, or electrical surges is the sole responsibility of the renter.

3. Supply of Products & Spare Parts

PowerStream supplies genuine, OEM-certified spare parts and brand-new industrial pump assemblies. Delivery timelines are estimated in good faith based on manufacturer availability and shipping schedules. Product warranties are provided directly by the respective manufacturers (e.g., Kirloskar, KSB, CRI, Crompton). PowerStream disclaims additional warranties, express or implied, regarding merchantability or fitness for a particular purpose.

4. Client Site & Operational Obligations

For equipment installations and site deployments, clients must ensure safe site access, stable and compatible electrical power supply matching the equipment specs, and appropriate pipe connections. The client is responsible for obtaining any local environmental, municipal, or discharge permits required for pumping and dewatering activities.

5. Limitation of Liability & Force Majeure

PowerStream Solutions shall not be liable for any indirect, incidental, special, or consequential damages—including but not limited to loss of profits, production downtime, or environmental cleanup costs—arising from equipment malfunction or delayed delivery. Neither party shall be liable for failures due to Force Majeure events, including natural disasters, strikes, or utility grid failures.

6. Governing Law & Jurisdiction

These Terms of Service and all business contracts are governed by and construed in accordance with the laws of India. Any legal disputes or claims arising out of our services or products shall be subject to the exclusive jurisdiction of the courts in Pune, Maharashtra.
